Legal Question in Civil Litigation in Maryland

Hi there.

I recieved assistance from the state (Maryland) for approx. 10 years when my children were young. Their father owes $50,000 to the state, but has not paid more than a total of $40 since 1988. He has been incarcerated numerous times since then for a variety of reasons, but would be held longer because of the $50K owed. He, their father, is asking me if I would essentially waive the child support now in an effort to keep him out of jail. I believe if he were to make payments, the state would take a perentage and I would get a small percentage. Well, a small percentage of nothing is nothing. This is one of those typical "you can't get blood out of a turnip" scenarios. I am willing to write such a letter, but naturally, am concerned about what exactly it would mean. What if he were to win the lottery? Any advice you can give me would be greatly appreciated. Thank you.

Since you received the bulk of your support from the state they have a lien and you are not in a position to waive it.
