Legal Question in Civil Litigation in Maryland

Help me Rescind Peace Order

For anyone who doesn't know, the state of Maryland makes it very easy to obtain a peace order otherwise known as a protective order with only weak or non-existant evidence to support the need for protection.

I am an unfortunate victim of the system who is being further victimized by the existance of several temporary peace orders from the same person. This is causing me to have problems obtaining employment, even though there was never one shred of evidence to support the claims of the person who filed them.

In four of these cases, I was never even notified that there would be a hearing for me to defend myself.

This person is the ex of my current partner. They have continuously violated the peace orders by traveling two states away to our residence to harrass me. I feel completely violated and that this person can effectively ruin my chances of a peaceful existance and successful career based on lies.

Please help me because I have called attorneys, the court clerk, the bar association and no one seems to know how to help me fix this. I work in a very high profile industry and this nonsense could ruin it all if it can't be fixed.

Any advice or assistance would be very much appreciated. thank you

Re: Help me Rescind Peace Order

By law, when you are served with a temporary peace order, the hearing date for the application for a permanent order is supposed to be placed on it, so either the law wasn't followed or you just didn't pay attention to that. The hearing must take place within 7 days. If a final peace order is granted, it's good for up to 6 months. You can apply for modification or rescission of a final order within its effective period.

It sounds like you should be applying for a peace order to stop the ongoing harassment. As for the effect on your employment prospects, since this doesn't involve a criminal conviction, I don't understand why your being subject to a peace order should have an adverse effect.
