How do you get a court ordered sale of home?

If you are having a dispute with a co-owner over selling the property, you have to file a lawsuit requesting the court to partition and sell the property. If granted, the court will appoint a trustee to conduct the sale. The trustee will charge you a fee, along with the usual sales expenses, such as an appraisal, brokerage commission, etc. It would therefore be best to try and work out your differences with one another before without having to resort to legal action.

A court ordered sale of a home occurs if a lender/judgement creditor institutes a foreclosure proceeding for failure to pay the mortgage or judgement. A sale can also be ordered if co-owners cannot agree to sell or keep the property or just want out of the situation.
