Scammed by crying ex-girlfriend
Is this fraud? This is my experience with a woman I was involved with for 6 months. Her mortgage bank notified her that foreclosure would begin if her account wasn't brought current (3months behind + next 1 month @ $1k/per). She claimed her husband hadn't sent court awarded monies to her.
She was between jobs, working on her divorce and crying. She asked for help to get past the immediate foreclosure. We agreed sell the home and leave the area together. I got an emergency cash advance on a credit card for $4k and drove her to the bank. I agreed to not charge her for the interest and she agreed to repay the cash when she sold the home. Verbal agreements only. She then started avoiding me. 2 weeks after that I found out she was participating in an intimate relationship with someone else beginning 1 month before she came to me for money. When I attempted to put a lien on her property she sold the home at a great discount within 3 days of notification of my intent.
Her husband now tells me that this is why he left her. He has the canceled checks that she claims weren't received. I've learned of $20k others have given her in the past 3 years. Should I supeona her bank records as evidence and get statements from other victims?

You may well have a good case for fraud but the real and practical question is what are your chances of ever getting your money back from this woman? If you had filed a suit against her before she was able to sell the property, it would have acted as a lien against it, but of course your lien would have been junior to the foreclosing lender, so it probably wouldn't have been much protection. Now she's probably secreting what ever money she got from the "sale" because you're only one of many people she's scammed. You can sue her in the District Court of Maryland to try and get your money back. Good luck.
