Legal Question in Civil Litigation in Maryland

When Suing a Person, Serve who?

I am suing a person, who has an Attorney. My question is simple. I don't know the person's schedule, but I know the person's Attorney's schedule.

Can you serve the court papers on the Attorney representing the person, you are suing or do you just serve Court Papers on the person who you are suing?

Re: When Suing a Person, Serve who?

You have to serve the actual defendant unless the person has authorized the lawyer to accept service. If the person is aware you are suing, it can't hurt to ask the lawyer to agree.
