my uncle passed away oct 26 2009. he had been incarcerated 18mon prior to his demise. However, he was in the midst of moving in with his girlfriend when he passed. since his passing my grandmother has tried on numerous attempts to contact this woman about retrieving his belongings from her home. She has left several voice mail messages as well as written postal notification has been sent to here. The girlfriend has flat out refused to give his mother anything to this day and has basically told her that she would destroy them or give them to charity before she allows his own mother to have his personal items. She is being very cruel and has always been jealous of his close relationship w/his mother. My grandmother has had a very hard time dealing with the sudden and unexpected death of her youngest child(son) and having his belongings to just touch, hold, or smell would give her much closer to such a untimely situation.

Are the things your grandmothers, your grandfathers, or owned by both? If it is hers, the situation is simple and you can just have a marshal go and help her retrieve it. If it is your grandfathers then it gets a bit more complicated but not too complicated. Did your grandfather leave a will or have his property probated? If either one occurred, all that property should have gone to the executor or administrator of his estate.
