Legal Question in Civil Litigation in Maryland

Vehicle Loss/Accident

Can I sue for the lost of my vehicle? My car was parked and someone ran into it and the insurance company totalled it, paid the value out, but I'm still out of a vehicle that was paid for and now have to come out of my pocket to replace.

Re: Vehicle Loss/Accident

If the other driver's insurance paid the value, you have to go out of pocket to replace it, but the insurance money is in your pocket. If they paid it, you accepted the payment as fair value, and that's the end of it. If your insurance co. paid you, it may have a claim against the other insurance co. or driver, but you don't because, again, you have been paid.
