How can I get a copy of a will, that is at least 3yrs old been in probate court and is now out

You should direct any questions you have about a will probated in Maryland (including a request for a copy), to the office of the Register of Wills in which the will was filed.

First, contact the personal representative or the lawyer for the estate and request a copy. If you've already tried that unsuccessfully, check with the register of wills in the county where the estate was probated to see if the will is on file there. The probate file is a matter of public record, so you should be able to gain access to it.
