Re: an affidativ of support

A sponsor's duty of support continues until the immigrant becomes a US citizen or has completed 40 quarters of work in the US (which is roughly 10 years). Divorce does not end a sponsor's duty to provide support.

If your husband sponsored you and you are not yet a US citizen and you do not have 40 quarters worth of qualifying work, his duty to support you continues whether you divorce or not.

The affidavit of support creates a contractual relationship between the sponsor and the sponsored immigrant. Failure to provide support is breach of that agreement. Further, if the sponsored immigrant takes any public assistance, the public agency providing such support can seek reimbursement from your husband.
