Legal Question in Immigration Law in Maryland

Change of status letter

I am F1 student who is currently out of status. While studying in college my mother who was a green card holder decided to apply for my green card. After she did this I received an approval notice of type ''Immigrant Petition for Relative,Fiance or Orphan from INS for ''Unmarried child 21/older of permanent resident.''Now my mother is a US citizen and she would like to upgrade my status. Now,on contacting INS and speaking to two different persons I was told the following :- 1)One representative at INS said that I would have to file a Form I-485.

2)Another representative said that I would only have to send a letter to INS stating that I would like to have my status adjusted along with my mother's proof of naturalization.

Which is correct? If the second choice is correct, then does anyone have a template of an ''upgrade of status'' letter that I can submit to INS.Thanks.

Re: Change of status letter

If you are already a permanent resident, then you do not need to file the I-485. It may be possible for your mother to sponsor a citizenship application on your behalf. I would need to know more details about your situation to be sure.
