expired visa

Hello, my name is boris. I am from russia. I am currently residing in the united states on an expired visa (may 2005). I was married to a US citizen in Novermber 2006. I would like to file paperwork to attain permanent residence status and a green card.

Can i still file for a green card after marrying a US citizen even if my visa has expired?

Because you entered the USA legally and were inspected at the time of entry, your US citizen spouse can still submit a visa petition on your behalf, even if your visa has expired. If you need any assistance with this process, feel free to contact my office. Good luck!
