Expungement of records

Hello ,

Me and my husband were charged for domestic violence some time back and the case was dismissed by the state attorney. Our record for these charges were expenged .We do not had any criminal record before. I work for a firm and I am currently on H1 visa. My firm is ready to apply my immigration for which I have to make my own arrangements ( like I have to get an attoryney to file my documents).

My worry is that my past that I was charged with domestic violence will effect any how my immigration process. Though my records are expunged. I have read the forms for immigartion ( Like for I 485) . One of the questions asked is '' have you been arrested,cited , charged, indicited or imprisoned for breaking or violating any law or ordinance, excluding traffic violatiosn''? What should be the answer for this in my situation.

Also, please let me know your fees for applying for immigrant visa.

You will need to disclose this event, but it is unlikely that it would result in a denial of your application.

The exact question must be read and answered correctly. Usually, it can only hurt you if you are cought making a false statement to the INS. I understand your case was dropped and expunged. The Fed. Government probably already knows, at least you have to assume they do, and you must be honest. You should obtain a lawyer. I can generally do one of these for $1500 plus expenses for the INS work up to the interview, and $350 for the interview.
