Legal Question in Immigration Law in Maryland
Green card for my son
I have been married to a US citizen for more than 4 years. I have had my green card for almost 2 years. When I came to marry him, I also brought my son with me. We started his paperwork when we filed for my green card. I need to know what will be the procedures to file the paperwork for my son because they told me I could file for his green card by myself because I already have it. Thanks.

Re: Green card for my son
In a case like yours, assuming your son was under 18 when the marriage occurred, your USC husband could have filed a separate petition so you son could have gotten a green card around the same time you recived your green card. Assuming the marriage occured while your son was under 18 and your son is under 21, & you are still together with your husband and he is willing to file for your son, that is the way it should be done because it is quicker than the other way. If your son was over 18 when the marraige occurred , then you will have no choice but to file for your son yourself. But it will take along time, maybe 5 years or longer, because of the long waiting list for visas in this category.

You or your spouse could apply for your son so long as he is under 21 and not married. Please contact me for more information.
