permanent residence status

I became a permanent resident in 2004 from an approved assylum pertition. I pertioned for my son and it was granted and he now lives in the usa. Now I need to pertition for my son (who just turned 20)to become a permanent resident. I filed an application that was not approved on grounds of my priorty date?My son was granted assylum as an assylee relative. Please advise me what my options are at this point especially given the fact that my so will be 21 soon.

Re: permanent residence status

Your son cannot file adjustment of status until he has been physically present in the U.S. for one year after he was granted asylee status. If he's over 21 and still unmarried by the time he's eligible to file AOS, he can file "nunc pro tunc" asylum application on his own.
