Legal Question in Immigration Law in Maryland

I am separated since past 41/2 years and divorce litigation is pending. What should I write in N400 form separated or married??? I also do not know my husbands whereabouts or any of his details...What should I put in???

Your marriage status is not really relevant on an N-400 unless you are applying for citizenship 3 years after receiving the green card, in which case it would be relevant, since you must still be living in marital union with the same spouse that got you the green card. On the other hand, if you're applying for citizenship more than 5 years after the green card, then you it doesn't matter if you're living with your husband or not.

In immigration forms, one can always add info. One is not stuck with one box or the other. Since divorce is not final yet, you should check the "married" box, but write to the side "separated for 4 1/2 years from husband."
