Legal Question in Immigration Law in Maryland

TN Sponsorship

I am curious as to how the TN visa works. Assuming you are on a TN visa, as a Canadian citizen and after 6 months of working with that company, you are let go or find another job, if you where to switch do you have to reapply for the VISA? any processing involved at all? If you are unemployed for a month period, do you have to leave the US, despite the TN visa still allowing you more time?

Also, can the VISA be renewed without crossing the border again? Also, can one apply for the VISA in advance of crossing the border to be sure entry is granted under VISA terms.

Thank you in advance.

Re: TN Sponsorship

While under TN you can switch jobs by having the new employer file form I-129 along with its supporting documents. The same form can be used by an employer to file for an extension of the TN. Not sure about being unemployed while in the country on TN -- it sounds like you'd be out of status but perhaps you'd be treated as a visitor at that point.

The regulations suggest that TNs for Canadians are only issued at the point of entry.
