Legal Question in Insurance Law in Maryland
Auto Accident Involving borrowed car
I loaned my brother-in-law our car and he ran a red light and hit another car broadside. Since I only had liability on the car and the accident was his fault, who's insurance pays for the car, the other persons car, and injuries that resulted from the accident. Since he had his own car insurance, would this cover both of the vehicles or only the vehicle that was hit?

Re: Auto Accident Involving borrowed car
Your insurance should provide you with coverage and a defense against any claims the other driver may make; as for your own car, you can seek redress from your brother direclty for damage t your car == your brother's own insurance (and your PIP coverage) will both apply as to any injuries suffered by your brother.
If your brother has an auto policy with collision coverage, it MAY provide coverage for your car -- you should make a claim with them.
If they don't pay quickly, you should have an attorney review the situation immediately.
