auto insurance claim limit of time to receive payment of claim

Are there statutory limits on the time in which a payment can be made out for an auto claim. Specifically a claim was made in 1998 but has not been paid due to insurance company holdups.

Generally where liability is admitted by the insurer, settlement should occur within 30 days. Otherwise, communication on the matter should be made every 45 days.

Where liability is not accepted by the insurer, these time periods do NOT apply.

The amount of settlement may be conditioned upon the facts of case. Unless you are familiar with settling automobile claims, you should contact an attorney.

Obtaining the service of an attorney is recommended for two reasons. First, an attorney knows the process and legal rights and obligations related to claims settlement. An attorney's skill in presenting the claim will prove to be valuable. Second, the amount of the settlement and payment of other matters usually more than covers attorney's fees. Subrogation, right of reimbursement, excessive claims for payment and other issues may arise with medical costs. Many other matters may arise during automobile insurance claim settlement.
