Children form Previous Marriage
My father has passed away and had a second wife. My siter and I are children from his first marriage. We do not know if there is a will or not. His wife recieved a considerable amount of money around $200,000.00 for his life insurance policy.I would like to know if we are entitle to more than $5,000.00. Not only that but he had a 401K plan also and should we recieve some of that too.

If there is a will, then the children of your father's first marriage would be entitled to inherit whatever this particular will provides for them.
However, if your father died intestate(without a will), then these children would be entitled to inherit from their father's estate according to the state scheme outlined in Title 64.1 of the Virginia Code.
