Hit and Run Driver - Uninsured Motorists Claim

II was hit by a Hit and Run Driver, my car totalled, I am injured. The officer made an error on the report stating I was moving at the time and the drawing is incorrect on the report as to the position and location of my vehicle. Further, upon investigation he lied to the claims adjustor and stated I was ticketed. He says I told him I was moving, but the report also states I could not identfy the vehicle, direction it was moving or anything related to the crash. I was in shock and talking out of my head for 4 days. I could not remember what happened and I did not give any statements to the Insurance Co. or police until my memory returned. Since that time, the insurance co. is now denying coverage on the uninsured motorists claim. I was not ticketed and I have contacted the capt. and asked for help in correcting this administrative problem. I am injured with signs of serious neurological problems and back disk problems. I have requested the officer correct the report, but if he doesn't, where do I go from here, I only have $2500.00 in PIP, and I need further medical treatment.

Without the facts of your matter, I am at a loss to provide a comprehensive assessment. Uninsured or underinsured claims generally require legal assistance. If you were ticketed, you should talk to an attorney. If an adminstrative error exists, then this should be clarified. Errors in accident reports are common and it takes the skill of an attorney to apply the facts, as asserted in the officer's report, to the claim. An error or ambiguity in an officer's accident report can, in some cases, be of benefit.
