Legal Question in Insurance Law in Maryland
Can the insurance co bill me?
Last year, while living in VA, I borrowed a
neighbors car and wrecked it. Unknown to me,
this was a company vehicle. The car was
totaled. I had a non-owners insurace policy
at that time. I was then contacted by the
insurance company stating that I was an
unauthorized driver and they would not cover
any legal bills as a result of this
accident. Later, I received a bill from this
company threatening to take me to collections
if I did not pay for the vehicle that was
wrecked as I was not an authorized driver.
This insurance company is based in
Maryland. I began making payments to this
company. I sent a letter after about six
months asking that they send me monthly
statements so I could better track my debt. I
received this generic computer printout with
the column headers " amt due, amt pd, and
date pd" penned in at the top- no account #
or company letterhead or anything that
indicated that this collection was
legitimate. Now I am wondering if I am liable
for this debt or if they were liable for
their own vehicle.I would like to reiterate
that I had no idea this was a company
vehicle.

The owner of the car or its insurance co. may have a claim against you if you were not authorized, and your insurance may or may not have a duty to cover you. You need to have a lawyer review the detailed facts and determine whether you are or are not liable. You may have a defense to paying or have a claim against your insurer to force it to pay.
