Medical bills

If my health insurance paid for all of my medical bill that I occur from a car accident. Am I responsible to repay my health from my settlement ?

The person that hit me only had $2,500 PIP coverage on his insurance and my medical bills are over 20,000.

PIP is personal injury protection and is payable

under your policy for your benefit. You should

be paid PIP up to the limits of the coverage through your policy. The other driver's bodily

injury coverage is where you will seek recovery.

Maryland minimum coverage is $20,000 for bodily injury. If you

have more than $20,000 in bodily injury coverage then an underinsured

claim can be made for the extra insurance that you carry. An underinsured

claim goes against your insurance and your insurance rate cannot be increased

due to this claim. The contract with your health insurer sets out their right to

reimbursement, this is referred to as subrogation. Health insurers often seek recovery; however,

this reimbursement can sometimes be negotiated. An attorney can assist you with these matters.
