if you go to gokster.com having no idea what it is and having no intention to download a song and you download nothing can you still get sued?

As a Franchise Attorney I can tell you the following. Making an illegal copy of copyrighted material, music, for example, is copyright infringement. If the download is authorized by the copyright owner, you're ok. If not, you're not ok. If you haven't downloaded anything, but simply visited a website, you presumably haven't made any copies (via download) - so how would someone sue you? Consult with a good business or franchise attorney in your area for specific advice.
