Legal Question in Employment Law in Maryland

on 06/07/10 i started to work with company in md. i was hire in as a truck driver. on 07/16/10 i was stop by dot in carson, va for inspection everything was fined except i didn,t have any brake lites on the trailer that i was pulling. dot put it out of service until it get repaired. the owner of the truck ask me to move the truck to the repair shop which was 3 miles away, i told him and dot told him that if i move the trailer i will be arrested and finded. dot close for the day and after they closed him told me to move the trailer since nobody was there. i informed him that was not going to move the trailer, when they told me not too. he told me to clean out the truck if i didn,t move the trailer. then he call back and said that a license mechanic was coming to fit the brake lites. i finish making my delivery and on 07/19/10 i was release from employment. i haven,t recieve my paycheck and know he put abandonment on my driving record. the police was there when i gave him the keys to the truck in md. i got a copy from my new employer stating that i abanded his equipment. i would like to know what can i do about this issue.

Based on everything you have written here, I think you did the right thing and I'm glad to hear that you are working for someone else now. There was no reason to put your livelihood and freedom in jeopardy so that your former employer could get his truck back.

I would hire a Maryland litigator (a lawyer who goes to Court a lot) who can help you file a lawsuit against the former employer, which would request a Court order that:

(1) forces the former employer to clear your driving record, and

(2) forces the former employer to pay the money owed.
