Fired due to an affair with boss
Employee has a 2-yr affair with boss. Employee knows the boss is married. Employee voluntarily discloses affair to boss' wife. Employee misses 2 days of work. Boss fires employee on 3rd day. Employee threatens to file EEOC claim based on being fired due to an affair. Does the boss have any recourse against an EEOC claim or does the employee have a valid claim?

An EEO complaint may be filed on the basis of race, color, religion, sex, national origin, age, physical or mental disability, sexual orientation, status as a parent and genetic information are prohibited by law. In order for a complaint to be recognized it must have one of these bases. Harrassment or hostile work environment based on any of the above classifications is also recognized.
Validity of the claim will be determined based upon the filing and its cognizable basis.
