Layoff due to personal reasons

Hello,

My Wife was layed off a few days before Christmas. The system in which they stated the layoff's were going to happen was by Senoirity. They ended laying off someone that was there much longer than others. My wife was the only female that held a position above an admin in a company that is nothing but males. The Director had personal problems with me when I worked there and he had personal problems when my wife was there. The owner is aware that the decision to lay her off was due to personal reasons and had nothing to do with her pay nor performance as the have spreadsheets stating that she was the most productive.

Does my wife have any leg to stand on. she has been on furlough and was just tols that they are not bringing her back.

There was also a conversation that was held in the office between her manager and the owner that they will not bring her back if she files a law suit.

We live in PA but she worked in MD

You asked about a possibly discriminatory layoff.

You actually have nothing to lose by bringing this claim, but the claim must be brought quickly. In most cases, claims of discrimination must be filed within 180 days of the adverse action.

You can look elsewhere, particularly in other answers and on various Web sites for information regarding discrimination in employment.

The claim here seems pretty clear. Though I'm certain it will be much more complicated once it gets rolling. They always are.

Again, you need to get counsel and bring this claim immediately to preserve your rights or you could lose the ability to ever bring this claim.
