non compete contract
I was just terminated from edward jones investments for lack of performance after only being there for 2 months. When I was hired I signed a contract saying that if I left and went to another firm I would have to reimburse jones 75000 for training costs. To my surprise another firm has offered me employment but only if I can get out from under this contract. Does the contract still apply since I didn't leave willingly? Can they restrict someone they fired from working elsewhere?

The contract should not apply in this case, but I would need to see it to know for sure. Some legal research might be needed as well. This is not a non-compete situation, but rather a reimbursement matter. It would arguably be unconscionable for a company to fire someone, especially after just two months, and then seek reimbursement. I suppose if there was extreme cause, such as the person murdering a co-worker, that could justify trying to get reimbursement.
