Legal Question in Employment Law in Maryland

hello, i am a police recruit. i was in the police academy in the six week i had to get emergency surgery for my appendix. i used my sick and vacation time to heal now that iam able to start work on august 30.2010 my job is stating that the county is on a freeze and if they are still on freeze by october 12 which my fmla is done i would get terminated.. is this right? can a case start?
