Can I be a sole proprietor if as an author I plan to pay a small royalty to my illustrator from each book sale?

Any individual (person) who runs a business without corporate or limited liability protection is considered a "sole proprietor". I would STRONGLY recommend that you create an LLC with the Maryland Secretary of State. It is easy, quick, and cheap. It will also provide you some liability protection if anyone ever sues you personally. Hire a Maryland corporate attorney for help.
