How to Terminate for Suspicion of Theft
Scenario: A janitorial employee who has worked for a company for about a year is placed at a different jobsite temporarily due to a layoff at his usual jobsite. His usual jobsite had experienced a theft about two months ago in his area, but the company did not have proof that he was involved. (He works in a union building and we knew that they would demand proof for termination.) While working at this ''other'' jobsite, a theft was reported -- again, in his area. Although we have no proof, we feel there is a good chance that he is connected. Therefore, we would like to terminate this man on suspicion of theft. We plan to say, ''There have been thefts reported in your area at two different jobsite. We are not saying that you are or are not responsible, but we do not feel that we can take the risk of keeping you at a jobsite. Therefore you are no longer considered an active employee.'' PLEASE ADVISE as to the best way to go about this and the best way to phrase our intent. Thank you.

the appropriate thing to do is go to a lawyer who would draft the letter for you so that you do not face a defamation case. since you are in business of this type, issues like this will come up often and you need a lawyer behind you to always lead you. Be careful.
