Legal Question in Employment Law in Maryland
I work for a ski area in Md. They do random and pre employment drug testing. The procedure consists of sitting in a room filled with other employees, opening a cotton like wad on a stick and putting it in your mouth for a certain amount of time. When the time is up the employer comes around and "reads" the test results. My question is is this legal? I dont mean the testing.. just from what I have read the test must be read by a "approved" lab. not a HR employee.

You are correct. So, will you be the test case by refusing the test? You are entitled to request the name of the certified testing facility at the time the test is administered.
