I am working 40 hours a week for a major department store but my employer is going into the timeclock and adjusting the hours I have worked to say i only worked 35 to keep his store within budget. What can I do?

An employee's rights will depend a lot on the factual specifics. For instance, were you given a lunch hour each day that the employer is deducting for or were you required to be on the floor all 40 hours? Modifying hours actually worked is very problematic and usually illegal.

You are encouraged to consult with an attorney to discuss the specific facts of your situation as well as the options, which include contacting the state (DLLR), possibly the federal DOL or privately pursuing claims against the employer. In cases with clear statutory violations the employer can be forced to pay the employee's legal fees.

My firm handles wage/hour violations and offers an initial phone call or EM consult of up to 10 min without cost.
