Legal Question in Landlord & Tenant Law in Maryland
We have been notified that the free assigned parking policy in effect up to now is being rescinded and we will be required to pay for unassigned parking. We have a disabled child and the assigned parking space is perfect as it is the closest one to our house. The loss of that spot will be a huge hardship for us. The leasing office said that they are exempt from having to provide accessible parking and they basically told us we had no recourse but to pay the parking fee or be towed. Can a leasing company unilaterally change the terms of the lease without our consent?
1 Answer from Attorneys
First, are you sure they are exempt from providing handicapped parking? This should be your first concern and may resolve your problem.
Second, check your lease regarding parking and modifications. The lease will control the type and timing of the modification.
