I want to sue a apartment complex for not retturning a rent payment and I don't recieve a aparment.They return my security deposit but did not return the rent what should i do?

Read your lease! Somewhere in the lease it probably states what happens if the landlord accepts the security deposit and first month's rent, but ultimately does not allow you to take possession of the apartment. If the 1st month's rent is not returned in the period of time prescribed by the lease, then you will have to sue in Magistrate Court.
