Legal Question in Landlord & Tenant Law in Maryland

When our washing machine broke in our upstairs apartment the landlord called his warranty company who sent out one of their contractors. The technician was unable to fix the machine and recommended a new washing machine. The landlord purchased an Avanti washing machine from a New York supplier which was shipped from Florida and manufactured in China. This new unit did not work. The landlord told us he waited a week to call the warranty company so as not to look �suspicious.� When the warranty company sent another technician out it was with a different contracted company than the original visit. When the technician attempted to fix the unit he noted right away that it was new and was unable to fix it because he didn�t want to void the manufacturer warranty. I got the landlord on the phone to speak with him but the landlord proceeded to demand that he fix it using expletives and claiming that the unit was not new but remanufactured (which it is not). The technician then refused to speak with the landlord and he left.

The landlord then told me to remove the Styrofoam and hook it up to appear less new. He is obviously attempting to defraud his warranty company. However when the warranty company spoke with me they were asking questions like �When did you get it?� and �What�s wrong with it?�

What should we do as we do not want to be a part of this fraudulent claim?

If your lease includes the use of the washing machine, your only option is to take the landlord to court and have the court order him to provide you with a working washing machine. You are under no obligation to play the landlord's games, however, you must keep paying rent in full.
