Legal Question in Legal Ethics in Maryland
My son had a protection from abuse order served on him on a Saturday. The order was made of whole cloth and he was supposed to appear in court this morning (Monday). He had documentation proving that all was said against him was false. When he got to court, a friend(a lawyer)who he knew through the woman that filed against him just 'happpened' to be in the courthouse and approached him. He said he had heard that he had served with the papers and that all this be ironed out if he came to his office tomorrow (Tuesday) and if he signed this form to get the court appearance delayed, they could put everything to rest with this with no harm to anyone. My son signed, and by looking online at case search, apparently he signed a waiver to say he wasn't challenging. This abuse order is now final. My opinion is that without a doubt this lawyer mispresented himself blatantly and probably was representing the woman. What can he do at this point to get that waiver removed so he can present his side to this total sham??? This happened in Maryland.
