Medical malpractice cases require a detailed review of the medical records AND a medical professional's opinion that the original provider messed up (breached the standard of care). They are not easily answered by an online post. The facts you present (surgery without consent) sound troubling but without a careful review an attorney cannot realistically analyze any potential claim. Whether or not you can sue is only one part of the question -- what kind of negatives (damages) occurred, how costly it will be to press a claim, the possible outcomes -- all these things go into analyzing a case.

If you believe you may have a medical malpractice claim, you may wish to contact a lawyer who practices in this area.
