Can I sue for pain and suffering caused by inadequate sedation (colonoscopy). This is a quote from the doctor and stated in the medical report. ''During the examination, I felt that the sphincter pressure was very tight and looked like the patient had not been properly sedated. Current state still have pain in right arm. Had to take off a days works, unable to sleep, having some problems going to the bathroom. I believe the bathroom problem may have come from the probe being forced into the rectum.

This sounds like a possible case, especially if you have a doctor's note like that. Definitely call us as soon as possible to discuss your recovery.

You have technically stated a claim for malpractice, however, the damages that might be recovered by jury award, do not justify the many hours and thousands of dollars it would take to pursue this case.
This is my opinion only, another attorney may feel differently.
