3-year old chokes on plastic in food

My 3-year-old daughter choked on a piece of plastic that was in my salad when we went out to eat. Although she is ok now, she had this piece of plastic lodged in her throat for about 45 mins. We were wondering if we had an legal recourse.

Depending on the circumstances, you could have a claim, but if it did not require medical intervention, the damages would be minimal.
