Legal Question in Personal Injury in Maryland

accident while running

my injury came as a result of an unmarked telephone guide wire that was run across a sidewalk. i was running down the sidewalk at dusk and smacked right into it chest first. the wire ''clothes-lined'' me back - cracking my head open and causing a 2nd degree AC separation in my shoulder. i began to take up correspondence w/the company i felt was responsible, but failed to follow through more than a couple letters. my QUESTION resides in the fact that this incident happened on 12.4.03 - seeing as it is now THREE years and change after this, am i outside a time limit to file some sort of claim? any help in this matter would be greatly appreciated!

Maryland's statute of limitation begins to run when you knew or should have known that you have a claim. In this instance this would be the date of your injury. A 3-year limitation applies to preclude your suit unless you are/were a minor beyond this period.

The statute of limitations for such claims is three years; thus when you failed to file a suit against the responsible party by last Dec. 4, you lost your claim. The only exception would be if you were under 18 when this happened--then you would have up to age 21.
