Attorney demanding a larger percentage (''cut'')

I am in a present case where we are suing a municipality over a sewage spill. Our attorney is wanting to sign another agreement stating that he will be getting 33 1/3% instead of the original agreed amount of 25% if the trial went longer than 2 years. Can the attorney do this? The initial case starts in 2 weeks.

Any agreement is subject to renegotiation if both parties are willing to do so. But you are perfectly within your rights to refuse to change the agreement that was made at the onset of the representation. At this late stage, he will have to continue with the case under ethical principles. He may not be happy, but he'd probably be equally resistent if the the case had settled early on and you decided you only wanted to pay 15%.
