Auto accident claim

I was involved in a auto accident on March1 2005. It was the other persons fault. I have had a neck injury (whiplash) I have not settled a claim is it to late the offered me 35000.00 I feel it is not enough to cover medical bills and time off of work. Is it to late to do anything.

The statute of limitations for filing a complaint in court is 3 years from the date of discovery of the cause of action, in this instance March 2005. You would be precluded from filing suit.

You may continue to resolve the matter through an insurance claim, but having lost the ability to file suit is significant.

To clarify, you would be precluded from filing suit on March 1, 2008. Loss of the ability to file suit is significant.

In MD you have 3 years from the accident to file suit (assuming it's not a governmental entity that you would be suing, or other unusual circumstances). But $35,000? That's a lot for a whiplash case, again absent unusual circumstances.

It is definitely NOT too late, but you ry should act quickly. Presuming that this happened in Maryland, the statute of limitations is 3 years from the date of the accident.
