Legal Question in Personal Injury in Maryland

i brought a brand new car 3 months ago it was damaged in melbournes hail storm, insurance is full comp and ther meant to cover it new for old for 3 years. they want to repair my car, but i understand if they do it will loose value an ive been told to put my foot down an demand a new one. the car has only done 2500kms hasnt even had it first service, any help would be great thanks, im from australia melbounre

Your insurance policy contains language which spells out the insurance company's duty to cover this kind of loss. Generally, you are entitled to have your vehicle restored to its condition before the damage was incurred. If the damage was major and the cost of repair would exceed the value of the vehicle, you are entitled to the fair market value of the vehicle just before it was damaged.
