Legal Question in Personal Injury in Maryland
Child sexual abuse in school
My husband and I recently found out that my son was sexually assaulted by another classmate in his school bathroom. He was 5 years old at the time and has named his predator as a classmate who was a year older at the time. In November 2001, I sought professional help. He had begun to defecate in his pants everyday. After the 2nd visit, his therapist said she believed he had every symptom of a child who was a victim of sexual abuse. Matthew finally broke down and admitted this and gave details. I don't know what to do, what type of law this falls under and because the public school system is directly involved, I'm just not sure how to handle the whole situation. Please advise me what type of lawyer I should be looking for. Thank you for your time and consideration. God Speed....

Re: Child sexual abuse in school
Although you didn't specifically say so, I'm assuming this situation was immediately brought to the attention of school authorities upon your discovery of what happened. If not, you should do so that an investigation can be conducted as to how this could have happened. Were the police notified so that a juvenile case could be considered, even given the young age of the suspected perpetrator?
You should immediately engage an experienced personal injury attorney to assist you with this claim. If there is some evidence that there was a breakdown in the school's responsibility to protect the children under its supervision, the school system may be liable for your son's injuries.
I would be happy to discuss this matter further with you if you would like to schedule an appointment.
