Legal Question in Personal Injury in Maryland

Hit by Uninsured/Unregistered in Maryland

On 2/17/01 while visiting my mother in Virginia we were driving in Maryland. We were stopped at a red light and were slammed by a driver we found out that was uninsured, unregistered and newly licensed at 17y/o. It appears the female driver was talking on her cell phone and was not paying attention when she hit us. I returned to my home in CA. on 2/20/01 and I went to see my primary dr. She gave me pain pills, told me I had whiplash and to come back if the pain continues. Two weeks later I returned and she prescribed physical therapy. I have completed the phys. therapy, and then I had a follow-up with my dr. She said there wasn't anything more she could do except recommend I take pain pills when I hurt. She also says there is no way to determine how long this will last. To this day my neck is constantly stiff and I have used numerous hours of sick leave.I am almost out of sick leave so I must work in pain. The ins. co. says they will reimburse all sick leave as well as pain & suffering. I have done some reading lately that says soft tissue damage is very hard to prove.Are there any tests I can have done or anything else I can do to prove to the world that my neck is in fact screwed up? Would an MRI help my cause? Thanks!

Some people take longer to heal than others. What is your UM coverage? They have to pay you just as if you were a third party claimant. That includes for pain and suffering. Unless your doctor suspects damage to the spinal column, and MRI won't help. As long as you don't have an attorney the carrier will just jerk you around. I have worked for most of the major carriers and I know the program. I practice in California and Indiana.
