Legal Question in Personal Injury in Maryland
can an insurance comp. be made to replace your vehicle
Hello--my daughter and i were involved in an accident where the other guy ran the stop sign and her car ended up totaled, and several people have told us to get them to replace the car, how would you go about doing so. Thanks

Contact the other driver's insurance company. They may declare that the car is "totaled" but you will only get what they say the car was worth at the time of the accident. This will probably be considerably less than what your daughter paid for it.

You should contact the other driver's insurance company immediately. The other driver's insurance company should pay you the value of the car at the time of the accident. Note that this may not be the "replacement value" or the "purchase price" of your daughter's car --- just whatever the car was worth at the time of the collision. Unfortunately, this may mean that you will get less than she paid for the car. (theoretically, they SHOULD give you enough so that you could buy an used car of similar make, model and condition).
I hope that everyone was o.k. in the accident. Please feel free to call me if you have any questions.
