Legal Question in Personal Injury in Maryland
i was invloved in a car accident 4 days ago that was not my fault. The driver admitted it was his fault and the policeman wrote in the report that it was his fault. I was the only one hurt (sprained back and thumb). His car was dented, mine was totaled. Should I get a lawyer to handle this and how much should i accept for the car? I still owe $2500 on my car, it woulda been paid off in less than a year. Now everyones telling me i will only get blue book value for it, which is less than what i owe. So i am gonna end up w/ no car and no money for a new one and the accident wasn't even my fault. This is not fair to me. I dont want extra $ or a brand new car, i just want the same kind of car i had. DO i have to accept what they offer? What happens if i do not accept their offer? what will a lawyer do if i get one? thanks for your time.

You should absolutely get a lawyer to handle this matter for you and stop listening to "everyone." A lawyer can help you get the best possible recovery from the insurance company. When the insurance company is notified that you are represented, their entire way of dealing with you will change. Additionally, their offers typically go up because they know that they are about to get involved in a costly and long litigation.
You DO NOT have to accept the insurance company's offer.
A lawyer will send a demand letter to your insurance company outlining your property losses and your injuries (if any). Usually in Maryland, property loss and medical injury are handled separately. If your insurance company denies the demand or is unwilling to negotiate a settlement that you believe is fair, your lawyer will have no choice but to proceed with filing a lawsuit.

I agree that you should stop listening to "everyone." But, I think you should try to get compensation for your injuries, pain, suffering, lost wages, as well as the property damage to your vehicle on your own before getting an attorney. If you still can't get what you want/need, then consult with an attorney, but be sure that you understand that most attorneys will charge you a third of your recovery. Regards,
