Legal Question in Personal Injury in Maryland
I was involved in a MVA in Oct, a car hit me in the back, as a result for about a week, I had a headache and a slight back ache. I treated it with rest and tylenol. I did not get a lawyer because I felt it was not that serious, I feel I should be compensated for my pain and suffering what should the other insurance company pay me. I should mention that they gave me a check for $ 688.00 to have my car fixed,

I cannot tell you what the other insurance company should pay you, if at all, without knowing a lot more about the facts of your case. Did the police issue a report? Were you at fault? The fact that the insurance company gave you a check for the repair of your vehicle, doesn't really mean anything -- insurance companies typically handle claims for property damage and claims for personal injury (medical bills, rehab, pain and suffering, etc.) separately. In other words, even though you have received a check for your property damage, does not mean that you have lost the right to make a claim for your injuries. With that said, it will be almost impossible to claim pain and suffering given that the pain and suffering was not bad enough to warrant a trip to the doctor. I strongly recommend that you consult a Maryland personal injury attorney (they likely will not charge you a fee for the consultation) to see what your options are.

Since you didn't get any medical treatment and the impact was apparently minor given the amount of the property damage, you shouldn't expect much if anything for pain and suffering. Geico typically won't offer anything in these kinds of cases. Other companies, like State Farm, may offer you $500 or so. You can probably get another opinion over the telephone from a personal injury attorney but the case is too small to make it practical for you to hire one.
