Legal Question in Personal Injury in Maryland

Involved in a rollover accident,not my fault, 9 days ago.acquired attorney the same day. Car was absolutely undriveable and towed . I have yet to feel comfortable with my lawyer's handling. I still don't even have a rental car. He advised me on that 1st day not to talk to anyone, including my insurance and I've complied. Yet I am carless and struggling to even make it to my therapy appointments. Is this normal to take so long to get any kind of compensation? what about my pip? Does that come much later? I'm feeling ignored.

I would speak to your attorney in a polite way about your concerns. It may be that he is doing everything he can, but the insurance company is dragging it's feet. Your attorney cannot do the impossible.

With that said, if you speak with him and don't get a warm fuzzy feeling, you are always free to fire your current attorney and retain a new one. There's plenty of plaintiff's attorneys out there who are willing to work hard for their money. If your current attorney has done any work on your case, he may be entitled to recover fees for that amount (either from you or out of any settlement/judgment you obtain), so I would be prepared for that.

If you have PIP coverage, it usually pays out within a month or so. Be patient -- that's an issue of your insurance company, not your attorney.

You need to feel comfortable with your attorney. Nevertheless, the law is a slow process. PiP forms should be completed and bills submitted. You should be looking to medical treatment first, and the replacement of your property next. You are entitled to the fair market value of your car at the time of the accident (9 days ago). Ask your attorney for progress reports. He should have no problem in providing them.

If you feel your present attorney is not performing you can seek another attorney. Recognize that the first attorney may be entitled to some compensation.
