Does the lawyer take 40 percent off the entire settlement....or do the medical bills get pad first ....and ten tame 40 percent....

Attorney fees are not set by law and thus each attorney and client reaches their own particular fee arrangement. (An attorney might handle a contingency case for 33% after medical bills, or 40% before medical bills or any other arrangement the parties agree to within the realm of reasonable fees). You are strongly encouraged to discuss attorney fees before signing a representation agreement - every attorney should clearly explain their fees and how they are calculated.
